SUBJECT: ADJUSTMENT , DERUBRIFICAZIONE AND CORRECTION OF A STRETCH OF ROAD VICINALE CALLED "THE PASSING".

The giorno 11 Ottobre 2007 , alle ore 18:00 , nella Residenza Municipale di Castrocaro Terme e Terra del Sole, si è riunita la Giunta Comunale, convocata nelle forme e nei termini di legge.

Subject: ADJUSTMENT, changing the classification and correction of a stretch of road VICINALE CALLED "THE PASSING"

Given that:

• Messrs. White Cimatti Maria and Franco Cimatti, with a note to the file with the City of prot. No 14589 of October 17, 2006, have applied for sdemanializzazione of a stretch of local road named “della Passanta”;
• Il tronco stradale in oggetto è inserito nel vigente elenco comunale delle strade vicinali, approvato con deliberazione di Consiglio Comunale n. 13 del 10 aprile 1965 e in esso denominata “della Passanta”;
• La richiesta in oggetto tende a rettificare una situazione consolidata nel tempo, già modificata nell’attuale tracciato nell’immediato secondo dopoguerra.

Visto che il disegno allegato evidenzia le porzioni di strada da sdemanializzare, individuate dal Foglio n. 4 p.lle 51-52 e Foglio n. 5 p.lle 48-49 (colorazione gialla), e le porzioni da rendere demaniali, individuate dal Foglio n. 4 p.lle 46-49 (colorazione rossa);

Considerato che, nel caso in esame, trattasi di regolarizzazione e di presa d’atto di una situazione risalente a molti decenni or sono e che la cartografia del territorio comunale nel vigente Piano Regolatore Generale (scala 1:5000) riporta l’attuale stato ed andamento viario della strada vicinale in questione;

Visti gli artt. 822 e seguenti del Codice Civile in ordine al regime giuridico dei beni soggetti al regime di beni demaniali ed al loro passaggio dal demanio al patrimonio disponibile;

Vista Regional Law No 19 August 1994 That Article 35. A delegation municipalities and provinces to adopt the measures for the declassification of the roads have the characteristics of roads and art. 2 provides that where there is no need to place a new classification, with the provision that provides for the declassification is determined by the difference in land use and road;

Ritenuto che non ricorra alcuna motivazione di interesse pubblico che giustifichi il non accoglimento della richiesta di rettifica in argomento;

Ritenuta la proposta di delibera in argomento meritevole d’approvazione;

Visto il parere favorevole, espresso ai sensi dell’art. 49, comma 1 del D. Lgs. 18 Agosto 2000 n. 267, dal Geom. Fabrizio Di Lorenzo, per la regolarità tecnica quale Responsabile dell’ Area Urbanistica, Edlizia ed Ambiente;

Con voto unanime favorevole espresso per alzata di mano;

1. OF SDEMANIALIZZARE declassified and in any operation of law, extinguish the public use, the scrap of land, formerly part of the local road loop, separate the CT of the City of Castrocaro Earth and the Sun identified in Sheet 4 with particles 51-52 and the sheet 5 with the part.lle 48-49, shown on the attached map in yellow;
2. regularizing and inscribed in ' Municipal list of local roads for public use the new section of the route of the local road called the Loop property Messrs. Cimatti Cimatti and Ezio Maria White, Sheet 4 to register in separate particles 46-49, shown on the attached map in red;
3. To authorize the Office of Technical Revenue Forlì to make the resulting changes in land for the regularization of situation existing plans of the land involved;
4. provide that a copy of this resolution be published for 15 consecutive days of Praetorian Roll the City, with the caveat that anyone interested may lodge an objection within 30 days of the end of that term;
5. In addition the publication of the This resolution, which took place to enforceability, to the Official Journal of the Emilia-Romagna, in accordance with the provisions of art. LR No. 4 of 35/94;
6. To declare this decision immediately enforceable in accordance with art. 134, paragraph 4 of the D. Lgv. 08/18/2000 No 267.
