Premesso che:

• Il dott. Carlo Costantino Buccheri, già segretario comunale di questo comune, rappresentato e difeso dagli Avvocati Pietro Plachesi di Forlì, ed Emanuela Buccheri di Forlì, ha presentato ricorso ex art. 700 C.P.C. al Tribunale di Forlì Sezione Lavoro per ottenere la sospensione dell’efficacia del provvedimento emesso dal Comune di Castrocaro Terme e Terra del Sole in data 14.09.2007 (Prot. n. 12684) e tutti gli atti correlati e conseguenti e per ottenere il reintegro del ricorrente medesimo nelle proprie funzioni di segretario comunale del Comune di Castrocaro Terme e Terra del Sole.

Considerato che l’Amministrazione comunale di Castrocaro Terme e Terra del Sole ritiene la piena legittimità del proprio operato e di tutti gli atti e provvedimenti connessi alla procedura di cui trattasi;

Ritenuta, pertanto, l’opportunità di autorizzare la resistenza alla lite e di affidare l’assistenza legale del Comune all’Avv. Giovanni Lauricella con studio in Forlì, via Primavera n. 35, giusta delibera della Giunta Comunale n. 5 in data 01/02/2007 di affidamento dell’incarico di assistenza legale per l’anno 2007;

Dato atto che l’incarico di cui trattasi rientra nel complessivo impegno di spesa taken in connection with the assignment of task described above in conjunction with Act No GC 5 / 2007.

Given the favorable opinions expressed under Article. 49, c. 1 of Legislative Decree no. August 18, 2000, No 267 by:

1. to authorize the establishment of the City by the Mayor, his legal representative, in the trial described in the application that is attached to this document to constitute an integral and substantive
2. To authorize the Mayor to use in the trial of care, as legal advisor of the City, 's Lawyer John Lauricella, the Court of Forlì
3. Of acknowledge that spending on skills, the fees and expenses, due to professional, you will meet with the appropriate commitment of the Municipal Council Resolution No. 5 on 1 February 2007 appointment of the legal assistance of the City for the year 2007;
4. To declare the urgency to provide for the establishment of the City in court, with separate clearly expressed unanimous vote, this decision immediately enforceable in accordance with art. 134.4 first paragraph of the Legislative LGD. 18.08.200, No. 267
