Given that:

No council action with

• 57 of 26.07.2007, the executive, the Council expressed its support to address the expectations of the ATR school transport service and approved the draft Convention for the period 2007/2010;

Rilevato che il Consorzio, al quale partecipano la Provincia di Forlì – Cesena e tutti i Comuni della Provincia, è un Consorzio di gestione di cui all’art.31 del D. Lgs. 267/2000 e che nello Statuto (art.3, 3^ comma) rientrano fra gli scopi istituzionali anche i servizi scolastici;

Rilevato che il Consorzio ATR ai sensi degli artt. 112 e 113 del D. Lgs. 267/2000, in quanto soggetto operativo degli Enti Locali soci, può gestire tutte le tipologie di servizi di trasporti previste dallo Statuto e rientranti nella competenza degli Enti Locali consorziati;

Noting that the network of school services can be integrated with public transport services operated by ATRA;

Given the known acts of the City with the protocol. 12425 of 11.09.2007, annexed to this resolution, by which the ATR communicate the economic conditions offered for the current school year;

view:

• that relations between the municipal administration ATR are regulated by the schedule annexed to the Convention of the City Council resolution No. 57, 26.07.2007;

• che l’art. 8 della convenzione della suddetta prevede fra l’altro la corresponsione all’Agenzia di un corrispettivo pari al 2% oltre IVA dell’importo per la produzione del servizio;

Dato atto che il maggiore compenso richiesto è dovuto alle variazioni dei percorsi e al maggior costo del carburante e del personale;

Vista la delibera della Giunta comunale n. 88 del 30.08.2007 di variazione al Bilancio;

1. Consortium of the entrust the ATR of the Forlì school transport service for the year 2007/2008 under the conditions described in the offer on prot. No 12425 of 11/09/2007, which is attached hereto. A to this resolution to form an integral and substantial part of it and the agreement annexed to the resolution of the City Council No 59/2003;

2. La spesa complessiva per l’anno scolastico 2007/2008 comprensiva del corrispettivo ATR ammonta a €. 100.078,35 (IVA inclusa) sarà impegnata:

• per €. 42.830,00 sul Cap.812 “Spese per trasporto scolastico” del bilancio di previsione 2007;

• per € 54.248,35 sul medesimo capitolo del Bilancio 2008 ove sarà previsto idoneo stanziamento;

• per €.3.000,00 sul Cap. 2133 There 1.08.03.03 "Cost of special transport line Pieve Greet" the Budget 2007;

3. To determine the rate of €. 148.00 for the service of transportation by bus for the entire school year;

Furthermore, given the urgency of custody of the service, with separate open vote, the council unanimously declare the immediate enforceability of this resolution under Article .134, paragraph 4, of Decree Law 267/2000.
