the town council

Since:

- the Town Council pays particular attention and a deep sensitivity to the policies of early childhood and adolescence;

- since the year 2006/2007 school year has started a pilot project called "Sperimentiamoci" for an educational afternoon to be held in the school premises and that it was widely supported among the families of the area;

ascertained the significant social and educational value initiative to be proposed for the school year 2007 / 2008;

felt obliged to set up a partnership agreement between the City, the Comprehensive School, the Parents Committee and the Coop. "The Reception of Forli, to carry out such activities;

Given the pattern established convention and considered the merits of adoption:

Invoked the existing rules for the grants and subsidies in the social, cultural tourism and sports approved under resolution n. 43, 15.5.2003, as amended and supplemented;

Given the favorable opinions under Article .47 D. Legislative Decree 267/200 of Dr. Annalisa Farina, Head of the concerned technical regularity as the file deposited at the office of secretary;

By unanimous vote by show of hands,

1. By activating a cooperation agreement between the City of Castrocaro and Land of the Sun, the Comprehensive School Castrocaro, the Association Committee of Parents of Castrocaro T. and TDS, and the Coop. "The Reception of Forlì, for the 2007/2008 school year to conduct extra-curricular activities;

2. Approve the attached diagram of the Convention as an integral and essential part of this resolution;

3. To authorize the legal representative pro tempore to sign the attached Convention the City of Castrocaro and Land of the Sun, by private deed;

4. To acknowledge that further measures will be undertaken with the necessary expenditure commitments;

5. To declare this act immediately enforceable under Article .134, 4 ° C. D. Decree Law 267/2000

CONVENTION FOR REGULATORY AGREEMENT

COLLABORATION FOR THE CONDUCT OF BUSINESS 'extra-curricular

- The existing municipal statute that .5 Article provides that "the City research collaboration and cooperation with all public and private, and encourages the participation of citizens, or individuals associated with political and administrative decisions of the community:

- Presidential Decree 275/99, which provides that educational institutions can promote or participate in arrangements for the coordination of activities of interest involving, on specific projects and specific objectives, institutions, organizations, associations or agencies operating on territory;

NOTING

• that such collaboration is aimed at better implementation of each school and extracurricular activities;
• that adherence to this agreement has been decided by the competent corporate bodies of the City of Castrocaro and the Comprehensive Land of the Sun and with specific resolutions that are attached to this document as an integral and substantial part of it;

- The City of Castrocaro and Land of the Sun Living in the person of Mrs. Dr. Frank, Mayor of the City of prot tempore Castrocaro and Tierra del Sun, authorized the signing of this agreement pursuant to the resolution of the City Council No of , Fiscal code n. enforceable by law, which the parties declare that they have read and want to run with this Convention and =

- The Comprehensive School Castrocaro - tax code 92046490402 in the person's legal representative Prof. Franco Severi, born on 25.03.1948 in Civitella, Head teacher at the Comprehensive Institute authorized the signing of this document by the Board of the Institute No of;

- The Association of Social Promotion Committee of Parents of the Institute including Castrocaro CF 92061220403 in the person of the President and legal representative Ms Elisa Biondi Tax Code BNDLSE 64C66 D704R;

- Cooperativa a rl ONLUS "The Home" located in Via Forlì Just boiling 110 VAT 02385850405 Legal representative in the person of Dr. Gilbert Casotti;

, IT IS AGREED AS FOLLOWS

ARTICLE 1 - Membership of this Agreement is given by the City of Castrocaro and Land of the Sun, Including Castrocaro Institute, the Association of Social Promotion Committee of Parents and the social cooperative "The Reception"

ART.2 - This Convention relates to the activation of extra-curricular activities to be carried out in the local elementary school and middle school for pupils residing in attending classes in primary and secondary levels;

ART.3 - The term of the agreement is related to academic year 2007/2008, the project includes:

for the elementary school

- two afternoons a week from 14.30 to 18.30 from September 25 to December 21 2007

for middle school

- one afternoon a week from 14.30 to 18.30 from September 24 to December 17, 2007.

possibly renewable for the period January-May 2008;

ART.4 - are defined in the following competencies:

COMMITTEE PARENTS

- Promotes and coordinates the initiative, after have highlighted the need in the territory;

- Find the cooperatives will implement the service and manages relationships with the same for the effective implementation of the project;

- Is committed for the purpose of the project, to apply for funding to the City of Castrocaro;

- calls for the use of school premises;

- is privileged with the Institute including for any problems that may arise during the implementation of the project;

- check periodically, including through specific stages of meeting between the leaders of the service, parents and the various institutions involved, the implementation of the initiative;

THE COMMON GROUND OF THE SUN Castrocaro and

- will award a grant of €. 3084.00 for the project

will provide the assistance that the Institute Including who will manage the financial part of the project.

INSTITUTE INCLUDING CASTROCARO

• is committed to settling the contribution paid by the municipality and any fees collected by the cooperative, "The Reception" on presentation of invoice issued by the cooperative society;

The Social Cooperative "Reception"

• undertake, as manager of the service, to comply as specified in the project referred to above, attached to this act, and chosen by the Parents' Committee;
• identify the teacher who will pursue the project;
• ask the families a monthly fee;
• in the performance of the service, the expert identified undertakes the supervision of pupils for whom the activity is given , assuming its responsibility for the damage that had to occur in a time of expectation of students to it.
• It also requires the storage of furniture, objects and other material used or otherwise present in the time of completion of performance;

ART.5 - For performance under this contract will not be paid additional compensation to the cooperative than deliberate;

This Agreement does not give rise to any treatment 'welfare and the Institute of Comprehensive Castrocaro provides only for the above period to hedge against Accidents resulting from civil liability;

ART.6 - The parties may terminate this agreement within .2237 of the Code;

ART.7 - In an emergency, is allowed to Head teacher of the suspension;

ART. 8 – Quanto non espressamente previsto dal presente contratto è regolato dagli articoli 2229 e seg. del c.c. In caso di controversie il Foro competente è quello di Forlì;

ART. 9 – Ai sensi degli artt. 11, 18,19 20,22 del D. Lgs. N.196 del 30.06.2003 e successive modificazioni ed integrazioni, si autorizza il trattamento e la comunicazione dei dati personali, in particolare di quelli sensibili, nell’intesa che gli stessi siano raccolti, detenuti, trattati e comunicati dall’Istituto Comprensivo Comune di Castrocaro Terme e Terra del Sole in base agli obblighi previsti dalla legge, dai regolamenti e dalla normativa comunitaria.

Il titolare del trattamento dei dati è il dirigente scolastico in carica.

L’esperto potrà esercitare i diritti di cui all’art.7 e seg. del medesimo D. Lgs.

Relativamente ai dati personali di cui dovesse venire a conoscenza, l’esperto è responsabile del trattamento degli stessi ai sensi del D. Lgs. 196/2003.

Il presente accordo viene pubblicato all’albo e depositato presso la segreteria comunale.

Per quanto non espressamente previsto si rimanda all’ordinamento generale in education and, mutatis mutandis, the rules of the Civil Code.
