day October 11, 2007, at 18:00 in the Municipale Residence of Castrocaro and Land of the Sun, met the City Council convened in the form and terms of the law.

Accertato che il numero dei presenti è legale per la validità della seduta, il sig. METRI FRANCESCA assume la presidenza e dichiara aperta la seduta, per trattare la proposta di deliberazione in oggetto.

OGGETTO : Piano di risanamento corpi idrici – scarichi di fognatura derivanti da agglomerati maggiori di 2000 A.E. – Comprensorio Forlivese – zona Forlì cintura periferica, relativamente all’abitato di Castrocaro Terme e Terra del Sole – via Longara

Given that:

- was established by the Agency for Setting and Integrated Water Management Service municipal waste, pursuant to art. LR No. 4 of 25 of 06/09/1999;

- the Convention signed on 02/01/2005 between the Agency of Scope of Forlì - Cesena and Hera Spa provides, inter alia, on the part of Hera Spa the performance of the design, construction, operation, maintenance and extraordinary lifting systems and networks related to the collecting sewer service;

Noting that of the activities scheduled in the plan by resolution No. ATO 10 of 29/12/2005 is inserted clean hygienic - sanitary sewer system via Longara, in order to allow the uptake of the discharge of an Imhoff tank, the construction of a pumping station and the construction of a sewer until to that available on a Longara;

acknowledged that Hera Forlì - Cesena Srl which institution manager, presented to the town of Castrocaro Terme e Terra del Sole, a note taken in the city at no protocol 262 of 05/01/2007, the final project, consisting of the following documents:

1. executive produced the project:

- Technical report;

- Classification map;

- General plan;

- Profiles longitudinal

- Details;

- photographs;

- Particles of expropriation

2. declaration of verification of compliance with zoning regulations, and standards of safety, health and environmental protection and landscaping, pursuant to art. 7, paragraph 2, of Regional Law No 31/2002, Annex sub letter A), showing that the proposed works:

1. comply with the approved planning instruments at the date of this report;
2. are in accordance with Regulation building regulations;
3. comply with sanitary regulations;
4. comply with current safety standards and require no prior opinion dei VV.FF.;
5. non interessano aree sottoposte a vincolo paesistico ai sensi dell’art. 146 del Codice dei beni culturali e del Paesaggio;
6. riguardano aree e terreni non soggetti a vincolo idrogeologico e non sono soggette né a rilascio di autorizzazione né a comunicazione;
7. rispettano le prescrizioni dell’ente gestore del servizio idrico, fognatura nera e di distribuzione del gas;
8. sono state progettate conformemente alla legge sismica n. 64 del 02/02/1974 e successivi decreti attuativi;
9. parte degli interventi sono eseguiti su terreni di privati di cui sono stati acquisiti idonei accordi preliminari da parte di Hera s.p.a.

Considerato che l’impianto fognario verrà realizzato in parte su strada comunale (via Longara) ed in parte su area di proprietà privata, destinata a verde pubblico e soggetta a cessione gratuita al comune in quanto facente parte di un piano di lottizzazione convenzionato con atto sottoscritto in data 20/10/1978;

Preso atto della concessione a titolo gratuito di permesso per la realizzazione delle opere di che trattasi sottoscritta dai proprietari (protocollo Hera s.p.a. Forlì-Cesena n. 51600 del 24/09/2007 e n. 52767 del 28/09/2007) agli atti del servizio public works;

A unanimous vote clearly expressed;

acting

1) to the motivations and purposes of narrative in the introduction, approve, pursuant to art. No 7 of the AL 31 of 25/11/2002, the draft of the work of "recovery plan bodies of water - sewage discharges from agglomerations of more than 2000 AE - Region Forlì - Forlì area belt device, relative to the village of Castrocaro and Tierra del Sun - via Longara ", written by Ing. Emanuele tenements of Forlì, commissioned by HERA Forlì - Cesena Srl;

2) to acknowledge that the work of that question is in the public interest in the question of municipal sewer;

3) to give also note that the works are urgent and can not be postponed and consistent with the zoning regulations and building codes and safety standards, health and environmental protection and landscape as declared by the designer in the note sub letter A);

4) work in road sections of the municipal jurisdiction, must meet the following requirements: "The plan viable bitumen in areas affected by excavation must be restored for the first time, immediately after backfilling, with a layer minimum compressed cm. 15 out of asphalt, size 0 / 18 (bynder sealed with a coat of emulsion and an acid sand), and only after it has completely run out of bedding material used for backfilling (except the cost of reloading whenever it will be necessary to ensure a secure enough movement), should be performed on surface course with a minimum thickness of compressed cm. 3 for the entire roadway width of public road concerned, after milling with a suitable mechanical means ";

5) to forward a copy of this measure at HERA Forlì - Cesena Srl for the prosecution in the making of;

Waiting the urgent need to provide;

to declare this act immediately enforceable, pursuant to art. 134, paragraph 4, of TUEL.

Article. 49, paragraph 1 of TUEL, expressed favorable opinion on alla regolarità tecnica.
