Visto:

la legge 6 marzo 2001, n.64, recante: “Istituzione del Servizio Civile Nazionale”;

il decreto legislativo 5 aprile 2002, n.77 recante: “Disciplina del Servizio Civile Nazionale a norma dell’art.2 della legge 6 marzo 2001, n.64”;

il Decreto Ministeriale 3 agosto 2006 che dettava le norme per la presentazione e i metodi di valutazione dei progetti di servizio civile per l’anno 2007

la comunicazione del Dirigente Responsabile del Servizio Programmazione e sviluppo del sistema dei Servizi Sociali. Promozione Sociale, terzo settore, Servizio Civile in data 29.05.2007 con la quale veniva comunicato che il Progetto “Le terre della Romagna Toscana: arte, cultura e storia” era stato valutato positivamente, senza limitazioni, con il punteggio di 51;

Considerato:

che il progetto suddetto è stato approvato dall'Ufficio nazionale per il servizio civile e inserito nel Bando di selezione per 38.922 volontari da impiegare in progetti di servizio civile in Italia e all’estero, pubblicato sulla Gazzetta Ufficiale della Repubblica , 4° serie speciale “ concorsi ed esami”, N° 46 in data 12.06.2007.

che i volontari hanno preso, alla data odierna, regolarmente servizio;

Tenuto conto:

che all’atto di presentazione del progetto in oggetto l’Ente si impegnava ad effettuare un corso per la formazione generale dei volontari della durata di 50 ore;

che in sede di accreditamento Il Sig: Guido D’Altri, formatore abilitato dall’ Ufficio Nazionale per il Servizio Civile, aveva dato la sua disponibilità ad essere inserito fra le figure professionali necessarie per l’accreditamento dell’ Ente in classe 2^;

Dato atto:

che il Sig. Guido D’Altri, come già avvenuto negli anni precedenti, conferma la propria disponibilità a tenere a titolo gratuito il corso di formazione dei volontari del progetto di servizio civile nazionale: “Le terre della Romagna Toscana: arte,cultura e storia” at the Town Hall, except for reimbursement of travel expenses to be repaid at the rate applicable in the Public Administration;

- As a delegate to the Head of Services to Citizens commitment and settlement of travel expenses incurred by the trainer;

- to forward a copy of this to the Head of Services to Citizens for the fulfillment of its mission;

- to declare, to the urgency, with separate open vote this decision immediately enforceable in accordance with Article .134, paragraph 4, of Legislative Decree no. 267/2000.

SUBJECT: APPROVAL OF EMPLOYMENT PLAN FOR THE YEARS 2007/2009

the town council

Abstract:
- that Municipal Council Resolution No. 332/99, n. 41/2000, No 87/2000, No 95/2000, No 14/2004, No And No. 78, 09/09/2004 27 of 30/03/2006 this Municipality has approved the new macrostructure institution, professional profiles and the new staffing;
- that the City Council by resolution No 17 of 19/02/2004 is the plan for employment for the period 2004/2006, as amended by subsequent resolutions no 37, 08/04/2004, No 113, 15/12/2005, No 52 of 06.17.2004, No And No. 47, 12/05/2005 28 of 19/04/2007;

possible, therefore, to proceed with the planning of filling vacancies for the years 2007/2009;

Given that on 09.10.2007 there was the delegation meeting to discuss treating, among others, the hypothesis of three-year plan 2007-2009 and employment during which the Administration sought the views of trade unions;

Given that Annex in recruitment was unanimously approved by City Council at its meeting on 10.18.2007 (Annex 1) were specified:
- year of implementation;
- Class and Profile professional vacancies;
- number of posts for job profile you want to play and how to cover the posts themselves, such as:
a) public competition or stabilization (where permitted);
b) processing of contract training and work into a contract or permanent transformation of post-elevation or reduction of hours of work prior amendment to the envelope organica;
c) mobilità esterna (si fa riferimento alla mobilità esterna prevista dall’art. 6, 20° comma, del D.P.R. 268/1987);
d) procedure di selezione per scorrimento verticale come definite in sede di contrattazione decentrata;

Dato atto che con nota prot. 14451 del 24/10/2007 è stato chiesto il parere alle OO.SS. e alle R.S.U. in merito al piano occupazionale triennale 2007/2009;

Visto il parere pervenuto via fax in data 06.11.2007 al prot. 14902 con cui le OO.SS. esprimono parere favorevole in merito al piano occupazionale previsto per l’anno 2007 mentre presentano alcune osservazioni sull’anno 2008, che si allega alla presente delibera per costituirne parte integrante e sostanziale della stessa (allegato 2);

Atteso che questo Comune, ai sensi e per gli effetti del D.M. 68/99 risulta coperto sulle categorie c.d. “protette” come da prospetto inviato con nota prot. 206 del 04.01.2007 al Servizio Provinciale;




Ritenuto necessario stabilire in sede di approvazione del Piano alcune indicazioni di principio alle quali ci si uniformerà nella fase di applicazione dello stesso e cioè:
- il Piano di copertura è vincolante solamente per l’anno in corso (2007), mentre per gli anni successivi indica semplicemente una previsione che non pregiudica la possibilità di scelte diverse;
- l’Amministrazione si authorized to proceed, even outside of this Plan of employment, to cover those places that may become vacant during the year for reasons not currently planned;

Given the Accounting Office in reference to the compatibility of economic and financial plan employment imputation in three years and the expenditure budget needed to cover the posts in 2007 noting that for the next year will cover the expense in their budgets;

Given the favorable opinions on art. 49, paragraph 1 of Legislative Legislative Decree 08/18/2000, n.267 by Dr. Annalisa Farina, head of the department concerned for the regularity tecnica;
Foligni rag. Giovanna, responsabile di ragioneria per la regolarità contabile e rilasciato dalla stessa l’attestato di copertura e impegno di spesa ai sensi dell’art.151, comma 4 del D.Lgs. n.267/2000, come risulta dal fascicolo depositato nell’Ufficio Segreteria.

Con voto unanime espresso per alzata di mano,

DELIBERA

- di approvare il Piano di copertura dei posti d’organico vacanti per il triennio 2007/2009 di cui al prospetto che segue (allegato 1);

- di dare atto che è rispettato quanto disposto dall’art. 3, comma 11, della legge 537/1993, così come sostituito dal D.L. 3.8.1995, n. 323;

- che spending needed to fill posts in the current year amounted to € 308.00 and is covered in the appropriate items of expenditure allocated to staff in its 2007 budget with the necessary appropriation and availability, while for the next year will cover the expense in their budgets;

- to declare, in a separate vote on this blatant act immediately enforceable pursuant to art. 134, paragraph 4 of the D. Decree Law 267/2000.

SUBJECT: Provincial Protocol on anti-discrimination

the town council

As in the province over the last decade the influx of foreigners has increased considerably, so much to reach the end 2005 6.1% of admissions compared to the native population in certain municipalities, touching bits equal to a percentage of 18%;

Since:

- art. 44, D. Legislative Decree 286/98 to in paragraph 12, states that it is the regions, in collaboration with the provinces and municipalities, with immigrant associations and volunteer organizations, the task of preparing observation centers, information and legal assistance foreigners, victims of discrimination on racial, ethnic, national or religious
- the Province of Forlì-Cesena sharing with the territory to the maximum integration policies for preventing the dynamics that could trigger social unrest, has signed 22 November 2002, together with 68 subjects of the province, the Provincial Protocol of Understanding on foreign immigration;
- art. 17 "Regional plan of action against discrimination contained in the Programme 2006-2008 for the integration of foreign citizens approved by resolution of the Legislative Assembly of Emilia Romagna No 45, 7 February 2006, which the \u0026lt;\u0026lt;Development and consolidation of a provincial network of public and not, for various reasons that deal with discrimination, coordinated by the individual provincial governments and aimed to develop specific action plans of provincial and in connection with the center regionale sulle discriminazioni.››;
- la Regione Emilia Romagna ha stipulato il 26 gennaio 2007 il Protocollo d’Intesa in materia di iniziative contro la discriminazione, dove le parti si impegnano ad aprire almeno un punto di referenza antidiscriminazione per Zona Sociale, di preferenza con sede nel comune capo-zona coordinati dalla Provincia;
- la Provincia di Forlì-Cesena ha incluso e presentato nell’ambito del Piano Provinciale per l’integrazione dei cittadini immigrati stranieri, il progetto del Centro Provinciale Antidiscriminazioni Razziali, attualmente gestito dalle Acli di Forlì-Cesena, la cui gestione richiede condivisione e sostegno del territorio;
- si è ritenuto di predisporre una bozza di Protocollo Provinciale d’intesa per dare valore a questo Centro, da condividere con il Coordinamento Provinciale sull’Immigrazione, istituito come luogo d’incontro e di condivisione delle azioni ed interventi mirati a favorire l’integrazione sociale dei cittadini immigrati stranieri presenti sul territorio provinciale;
- il Protocollo prevede l’impegno della Provincia di Forlì-Cesena, in accordo con gli Enti, di coinvolgere i soggetti territoriali intenzionate ad aderire e le figure istituzionali ritenute più opportune, (es: difensori civili, consiglieri di parità, giudici di pace, patronati, centri antiviolenza, associazioni di migranti e di tutela dei diritti, associazioni iscritte at the regional register), so that share the goals and participate in the achievement of goals;

Given the shared objectives of this Protocol, which took place in the Provincial Coordination on Immigration, held on May 11, 2007, and containing between points situated at 'agenda the examination of the "Protocol for Provincial actions against discrimination;

Considered that:
- Memorandum of Understanding aims to create a table of comparison and discussion between the parties, supportato dal Centro Provinciale Antidiscriminazioni Razziali, che basa la propria azione sulle quattro funzioni, ovvero: prevenzione, promozione e sostegno di progetti ed azioni positive, rimozione delle condizioni di discriminazione, monitoraggio e verifica, atte a promuovere la cultura di parità di trattamento dei cittadini immigrati stranieri presenti sul territorio provinciale di Forlì-Cesena;
- il protocollo prevede l’impegno della Provincia di Forlì-Cesena, in accordo con gli Enti, a favorire sul territorio provinciale politiche antidiscriminatorie, seguendo le linee di una pianificazione strategica di interventi finalizzati a promuovere la cultura di parità di trattamento, da progettare e realizzare attivando la collaborazione interdepartmental and sharing, in order to contribute to the integration of foreign immigrants;
- the protocol is designed essentially aimed at ensuring the immigrants in the Province of Forlì-Cesena and therefore the City of Castrocaro and Tierra del Sun, a full inclusion in the local community, promoting conditions for social integration that respects the rights and needs of all its individual and social components.

Given the favorable opinion, expressed in accordance with Article 49, paragraph 1, of Legislative Decree no. 18.08.2000, n.267, for technical correctness, the Head of Service concerned;

With unanimous vote: RESOLUTION



1) to approve the Memorandum of Understanding, attached below as an integral and substantial part of this resolution, promoted by this administration;

2) to authorize the Mayor Frank Meters, on behalf of the City of Castrocaro and Land of the Sun, following the signing of the Protocol annexed having among the main targets for immigrants to ensure the right of equal treatment;

3) to acknowledge that each signatory party, will be responsible for performing the functions and activities already listed in the Protocol referred to the object in order to achieve close cooperation between all party to the proceedings;
4) to acknowledge that the City Administration will provide support and assistance to the Protocol in question, limited to the availability of its financial statements;

5) to forward the following resolution to the Head of the economic, financial, For your information, and the Head of Administration and Human Services for the continuation of its jurisdiction.

6) to declare, in a separate vote on this blatant act immediately enforceable pursuant to art. 134, paragraph 4 of the D. Decree Law 267/2000.
